4. Copyright Infringement Notification Procedure

4.2 Requirements for a Valid DMCA Takedown Notice
To be considered a valid and actionable notice under 17 U.S.C. § 512(c)(3) and this Policy, a copyright infringement notification must include all of the following elements:
— A physical or electronic signature of the person authorized to act on behalf of the copyright owner.
— Identification of the copyrighted work(s) claimed to have been infringed. If multiple works are covered by a single notification, a representative list of such works is acceptable, provided it is sufficiently specific to allow identification of each work.
— Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit IPTVSubscription.me to locate the material. This must include the full URL(s) or precise description of the location of the content within the Service.

4.4 Processing Timeline
Upon receipt of a valid and complete DMCA takedown notice, IPTVSubscription.me shall:
— Acknowledge receipt of the notice within two (2) to five (5) business days.
— Conduct an internal review to assess the validity and completeness of the notice within five (5) to ten (10) business days.
— Where the notice is found to be valid: promptly disable access to or remove the allegedly infringing material from the Service.
— Notify the subscriber or user responsible for the affected content (where identifiable and legally permissible) of the removal and provide them with a copy of the takedown notice.
— Document all actions taken in response to the notice in the Company's internal DMCA compliance register.
4.5 Incomplete or Defective Notices
A notice that fails to substantially comply with the requirements of Section 4.2 shall be deemed defective and will not trigger the Company's takedown obligations. IPTVSubscription.me reserves the right to request additional information or clarification from the submitting party. Knowingly submitting a materially incomplete or misleading notice may expose the submitting party to liability under applicable law.
5. Counter-Notification Procedure
5.1 Right to Submit a Counter-Notification
A subscriber or user whose content has been removed or disabled as a result of a DMCA takedown notice may submit a counter-notification if they believe in good faith that the material was removed or disabled as a result of mistake or misidentification. The counter-notification procedure is established by 17 U.S.C. § 512(g)(3).
5.2 Requirements for a Valid Counter-Notification
To be valid under this Policy and 17 U.S.C. § 512(g)(3), a counter-notification must include:

— Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access was disabled.
— A statement under penalty of perjury that the subscriber or user has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
— The subscriber's or user's name, address, and telephone number, and a statement that the subscriber or user consents to the jurisdiction of the Federal District Court for the judicial district in which the address is located (or, if outside the United States, to the jurisdiction of the competent courts of the Netherlands, where IPTVSubscription.me's principal place of business is located), and that the subscriber or user will accept service of process from the person who provided notification of the alleged infringement.
5.3 Processing of Counter-Notifications
Upon receipt of a valid counter-notification, IPTVSubscription.me will:
— Promptly forward a copy of the counter-notification to the original complaining party.
— Inform the complaining party that IPTVSubscription.me will restore or re-enable access to the removed material within ten (10) to fourteen (14) business days unless the Company receives notice that the complaining party has filed an action seeking a court order to restrain the subscriber from engaging in the alleged infringing activity.
— Restore or re-enable access to the material upon the expiration of the notice period, absent receipt of a court order or other legal process requiring continued restriction.
6. Repeat Infringer Policy
6.1 Adoption of Repeat Infringer Policy
In accordance with 17 U.S.C. § 512(i)(1)(A), IPTVSubscription.me has adopted, and reasonably implements, a policy that provides for the termination of the accounts of subscribers and users who are repeat infringers of intellectual property rights. This policy is applied consistently and without exception.
6.2 Definition of Repeat Infringer
For purposes of this Policy, a "repeat infringer" is defined as any subscriber or user against whom IPTVSubscription.me has received three (3) or more valid and uncontested DMCA takedown notices within any rolling twelve (12)-month period, or against whom a competent court of law has issued a finding of copyright infringement in connection with their use of the Service.
6.3 Enforcement Measures
Upon identification of a repeat infringer, IPTVSubscription.me reserves the right to take one or more of the following enforcement actions, at its sole discretion:
— Suspension of the user's subscription account with or without prior notice.
— Permanent termination of the user's subscription account and any associated accounts under common ownership or control.
— Forfeiture of any prepaid subscription fees, to the extent permitted by applicable law.
— Disclosure of subscriber information to rights holders or law enforcement authorities pursuant to valid legal process, applicable data protection law, and the Company's Privacy Policy.
— Referral of the matter to competent legal authorities for civil or criminal proceedings, where warranted.
7. Limitation of Liability and Safe Harbor
7.1 DMCA Safe Harbor
IPTVSubscription.me operates in compliance with the safe harbor provisions of 17 U.S.C. § 512(c), which provide that an online service provider shall not be liable for monetary relief for copyright infringement arising from the storage of or access to material provided at the direction of users, provided that the service provider: (i) does not have actual knowledge that the material or activity is infringing; (ii) upon obtaining such knowledge or awareness, acts expeditiously to remove or disable access to the material; (iii) does not receive a financial benefit directly attributable to the infringing activity; and (iv) upon notification of claimed infringement, responds expeditiously to remove or disable access to the allegedly infringing material.

Nothing in this DMCA Policy shall be construed as a waiver of any rights or defenses available to IPTVSubscription.me or Apex Vision Holding under applicable law, including but not limited to defences of fair use, fair dealing, or equivalent doctrines under the laws of the Netherlands, Singapore, and the United States.
7.3 Third-Party Content
To the extent that IPTVSubscription.me transmits or provides access to third-party content pursuant to its IPTV service, such transmission is performed solely in accordance with the technical requirements of the service and not as a deliberate act of reproduction or distribution by the Company. The Company disclaims all liability for infringing content generated, uploaded, or transmitted by third parties outside the Company's knowledge, direction, or control.
8. Misrepresentation and Abuse of the Notice Process
Pursuant to 17 U.S.C. § 512(f), any person who knowingly materially misrepresents: (i) that material or activity is infringing; or (ii) that material or activity was removed or disabled by mistake or misidentification, shall be liable for any damages, including costs and attorneys' fees, incurred by the alleged infringer, by any copyright owner or copyright owner's authorized licensee, or by IPTVSubscription.me, who is injured by such misrepresentation.
IPTVSubscription.me will not process, and reserves the right to disregard, takedown notices that appear to be submitted in bad faith, as competitive harassment, or as part of any coordinated effort to disrupt lawful business operations. 10.2 Confidentiality of Complainant Information
Personal data submitted in connection with a DMCA notice or counter-notification is processed in accordance with the Company's Privacy Policy and applicable data protection legislation, including the General Data Protection Regulation (EU) 2016/679 ("GDPR") and the Dutch Implementation Act of the GDPR (Uitvoeringswet AVG). Such data will not be disclosed to third parties except where required by law, court order, or as necessary for the resolution of the relevant intellectual property dispute.
11. Policy Updates and Amendments

Rights holders located in the United States may alternatively elect to bring proceedings in the appropriate U.S. Federal District Court with competent jurisdiction over the matter.
